ENTERPRISE SERVICE AGREEMENT

Terms & Conditions

Establishing the parameters for excellence and reliability on the CloudNVMe network. Effective as of: February 2026

1. Acceptance of Terms

By accessing or utilizing any services provided by CloudNVMe (Established in 2019), you agree to be bound by these Terms and Conditions. We are recognized as market leaders in the USA and globally for performance infrastructure, and these terms ensure the stability of our entire user ecosystem.

2. Service Provision (SLA)

CloudNVMe commits to providing enterprise-grade hosting services powered by Gen4 NVMe and AMD EPYC™ hardware. We offer a 99.9% Uptime Guarantee as part of our commitment to professional reliability. Maintenance windows are typically scheduled during off-peak USA hours to minimize impact.

3. Billing & Payments

  • Subscriptions: All services are provided on a pre-paid basis (Monthly or Yearly).
  • Renewal: Services auto-renew at the end of the term to prevent data loss or domain expiration.
  • Refunds: We offer a 30-day money-back guarantee for new cloud hosting accounts if performance metrics are not met.
  • Cancellations: Users may cancel their services at any time through the Client Portal.

4. Acceptable Use Policy (AUP)

To maintain our status as high-performance leaders, we strictly prohibit the use of our infrastructure for:

  • Spamming or mass unsolicited emailing.
  • Hosting or distributing malware, viruses, or illegal content.
  • Cryptocurrency mining or excessive resource harvesting that impacts other users.
  • Any activity that violates USA or international law.

5. Account Security

Users are responsible for maintaining the security of their login credentials. While we provide Imunify360 AI protection at the server level, users are encouraged to utilize Two-Factor Authentication (2FA) and maintain secure application-level passwords.

6. Backups & Data Integrity

While we perform automated daily off-site backups for disaster recovery, it is the user's ultimate responsibility to maintain independent copies of their data. CloudNVMe is not liable for data loss resulting from user-side errors or outdated application security.

7. Limitation of Liability

CloudNVMe shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our infrastructure. Our liability is limited to the amount paid for the service during the current billing period.

8. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts within the USA jurisdiction where our primary infrastructure is registered.
